2. Acceptance of Terms

By booking a session, attending a seminar, requesting a home visit, or enquiring about any Service, you confirm that you have read and agree to be bound by these Terms.

You must be at least 18 years old and have the legal capacity to enter into an agreement under the laws of the Kingdom of Thailand. If you are booking on behalf of another person, you confirm that you have authority to do so and that the person attending also accepts these Terms.

These Terms constitute the entire agreement between you and Eldernest in relation to the Services, unless a separate written agreement has been signed.

3. Service Description

Eldernest provides educational and organisational services in the area of retirement transition. Our three current offerings are:

• Retirement Readiness Seminars — group educational sessions covering lifestyle planning and practical preparation, held at our Chiang Mai office.
• Personal Filing System Setup — a one-to-one home visit within the Mueang Chiang Mai area to help organise household papers and documents into a clear, labelled system.
• Community Support Circles — facilitated peer-group sessions for people sharing experiences of retirement transitions.

Services are delivered in English and are available to individuals based in or visiting the Chiang Mai area. We do not provide services remotely at this time unless separately agreed in writing.

Eldernest reserves the right to modify, reschedule, or discontinue any Service on reasonable notice.

4. Bookings & Enrolment

All bookings are subject to availability. A booking is confirmed only once Eldernest has sent a written confirmation by email.

For group sessions, places are allocated on a first-come, first-served basis. Session sizes are capped to maintain quality; we do not add participants beyond the stated limit.

For home visits, you are responsible for ensuring the address provided is accurate and accessible. Visits are limited to the Mueang Chiang Mai district.

5. User Responsibilities

When using any Eldernest Service, you agree to:

• Treat facilitators and other participants with courtesy and respect.
• Not record, photograph, or share the content of any session without prior written consent from Eldernest.
• Not share or distribute any printed or written materials provided during a session to third parties for commercial purposes.
• Not use information shared by other participants in any session outside of the session context.
• Provide accurate information when booking, including name, contact details, and address (for home visits).
• Notify us promptly if you need to cancel or reschedule.

You understand that Eldernest sessions are informational and educational. They do not constitute financial, legal, medical, or any other form of professional advice. Any decisions you make following a session are your own responsibility.

6. Payment Terms

All prices are quoted and payable in Thai Baht (THB). Current prices are:

• Retirement Readiness Seminar — ฿4,800 per person
• Personal Filing System Setup — ฿17,000 per visit
• Community Support Circles — ฿32,500 per programme

Payment is due in full prior to attendance or the start of a home visit, unless otherwise agreed in writing. We accept bank transfer and cash payments. Eldernest will confirm accepted payment methods at the time of booking.

Prices may be updated periodically. Any price change will not affect confirmed bookings already paid.

7. Cancellations & Refunds

Cancellation by you: If you cancel more than 7 days before a session, you will receive a full refund. Cancellations made between 3 and 7 days before a session will be refunded at 50%. Cancellations made within 3 days of a session are non-refundable, though we will offer a transfer to another date where possible.

Cancellation by Eldernest: If we need to cancel or reschedule a session, we will notify you as early as possible and offer either a full refund or a transfer to the next available date.

Refunds are processed within 14 working days via the original payment method where possible.

8. Intellectual Property

All Content produced or distributed by Eldernest — including session handouts, notes, guides, templates, and written summaries — remains the intellectual property of Eldernest.

You are granted a personal, non-exclusive, non-transferable licence to use Content for your own private, non-commercial purposes. You may not reproduce, distribute, sell, or adapt Content without written permission from Eldernest.

Content shared by participants during sessions remains the property of the individual who shared it. Eldernest does not claim any rights over personal information or stories disclosed during sessions.

9. Disclaimers

Eldernest's Services are provided on an informational basis only. Nothing shared during any session constitutes professional financial, legal, tax, medical, or psychological advice. Eldernest does not hold professional licences in any of these fields.

Outcomes from filing system organisation depend on the individual's circumstances and ongoing maintenance. Eldernest cannot take responsibility for the accuracy or completeness of any documents we help you organise; we do not review or verify document contents.

To the extent permitted by Thai law, Eldernest provides Services on an "as is" basis and makes no representations regarding specific results or outcomes from attending any session.

10. Limitation of Liability

To the fullest extent permitted under the Civil and Commercial Code of Thailand and applicable consumer protection laws, Eldernest's total liability to you in connection with any Service shall not exceed the amount you paid for that specific Service.

Eldernest is not liable for any indirect, incidental, or consequential losses, including loss of income, loss of data, or any decisions made based on information shared during a session.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud.

11. Indemnification

You agree to indemnify and hold harmless Eldernest, its staff, and facilitators from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of any Service, or any false information you provide during booking or attendance.

12. Termination

Eldernest reserves the right to refuse or terminate access to any Service if a participant's conduct is disruptive, disrespectful, or in breach of these Terms. In such cases, no refund will be provided.

You may stop using our Services at any time. Cancellations are subject to the terms in Section 7 above.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand, including the Civil and Commercial Code and the Consumer Protection Act B.E. 2522 (1979) as amended.

If a dispute arises, we encourage you to contact us first at [email protected] so we can attempt to resolve it informally. Most concerns can be resolved by direct conversation within a few days.

If informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Chiang Mai Province, Thailand.

14. General Provisions

• Entire agreement: These Terms, together with any booking confirmation, form the complete agreement between you and Eldernest regarding the Services.
• Severability: If any part of these Terms is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure by Eldernest to enforce any right under these Terms does not constitute a waiver of that right.
• Assignment: You may not transfer your rights under these Terms to any other person. Eldernest may assign its obligations in the context of a business transfer.
• Notices: Formal notices to Eldernest should be sent to [email protected].

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

If you have an existing confirmed booking, the Terms in force at the time of your booking will apply to that booking. Continued use of our Services after an update constitutes acceptance of the revised Terms.
